Attention for Warehouse Owners: Don’t Forget to Fulfill Your Obligations!

“For warehouse owners, it is obligatory to carry out the legality of the establishment and management of their warehouses. Including reporting warehouse data to the government authorities.”

Distributors or producers as business actors generally have a warehouse to store their merchandise inventory. The warehouse can be around or even in a different location from the main company.

In addition, a warehouse can also be owned by individuals or business entities. Generally, this person will rent out the warehouse to certain parties who need it, for example, producers, distributors, agents, and so on.

However, the warehouse cannot be used carelessly. There are laws and regulations that regulate the legality of warehouse use.

The warehouse owner has 3 (three) obligations that must be fulfilled to support the legality of the business, including the following.

 

Registering Warehouse

The warehouse owner is required to register the warehouse. The document for proof of registration of a warehouse is called a Warehouse Registration Certificate (TDG).

The obligation to register warehouses in detail is regulated in Government Regulation Number 29 of 2021 concerning Operations in the Trade Sector (PP 29/2021) and Minister of Trade Regulation Number 90 of 2014 concerning Warehouse Arrangement and Development (Permendag 90/2014).

Warehouse owners can register TDG in the Online Single Submission system. Therefore, warehouse owners are required to have a Business Identification Number (NIB) and know the Standard Indonesian Business Field Classifications (KBLI) according to their business activities.

TDG is part of the business licensing to support business activities (PB UMKU). The warehouse owner’s obligation to obtain TDG is to fill and complete several requirements, as follows:

  1. Warehouse address and coordinates
  2. Documentation view front, right side, left side, back, and in the warehouse
  3. Warehouse Registration Sign technical data form

Documents that need to be prepared to fill out the TDG technical data form:

  1. Identity Card (KTP) for Indonesian citizens, passport or KITAS for foreigners
  2. Warehouse data (address, coordinates, area and capacity, class, type, and contents of warehouse)
  3. Person in charge of data (address and telephone number)
  4. Company data (email)

 

Managing Warehouse

The warehouse should be managed properly by the warehouse manager. The management is in the form of recording warehouse administration regarding the type and amount of goods stored, entering, and leaving the warehouse (PP 29/2021).

The administrative records that must be carried out by the warehouse manager are, among others (Article 65 paragraph (1) PP 29/2021):

  1. Owner
  2. NIB of the owner of the goods
  3. Item type or group
  4. The number of goods
  5. Item entry date
  6. Origin of goods
  7. Item release date
  8. Item destination
  9. The rest of the goods are stored in the warehouse (stock)

The administrative records containing the above information are recorded in the warehouse administration book or an electronic system (Permendag 90/2021).

However, there are several types of warehouse use that are not required to carry out administrative records, including (Permendag 90/2014):

  1. The warehouse used to store goods with a warehouse receipt system
  2. A warehouse that is used as a temporary storage place for goods delivery services

 

Doing Warehouse Report

Warehouse managers are required to report warehouse administration records to the Minister of Trade, Governor of DKI Jakarta (for those domiciled in DKI Jakarta), regents/mayors, or other appointed officials (PP 29/2021 and Permendag 90/2014).

At least, warehouse owners are expected to report to the Ministry of Trade regarding warehouse administration records every 1 (one) month electronically (Irene Yasmine, Socialization of Warehouse Registration Certificates, YouTube OSS Indonesia).

 

Warehouses Excluded from Warehouse Registration Obligations

Based on PP 29/2021 and Permendag 90/2014, there are several types of warehouses that are exempt from carrying out warehouse registration obligations, including:

  1. Warehouse located in a bonded stockpile.
  2. Warehouses located in stockpiles under the supervision of the directorate general in charge of customs.
  3. Warehouse attached to a retail/retail business that is used as a temporary storage place for retail merchandise, or a warehouse attached to the place of production.
