Let’s Learn More About Travel Agency Business Licensing!

“Business actors in the Travel Bureau are required to have a Business Certificate as their business license.”

For business actors, licensing is an important thing that must be fulfilled. Because by obtaining a license, the business can be protected by law for the sake of business continuity. Likewise, the Travel Bureau (“BPW”) business actor needs to take care of licensing for the requirements to support his business. So, what are the licenses that must be considered by Travel Bureau business actors? Check out the following explanation:

Business Form

Article 7 paragraph (1) of the Regulation of the Minister of Tourism of the Republic of Indonesia Number 10 of 2018 concerning Electronically Integrated Business Licensing Services for the Tourism Sector explains that Applicants for Business Licensing for the Tourism Sector consist of:

  1. Individual business actors; and
  2. Non-individual business actors.

The sole proprietorship as referred to is a form of business managed by one person who controls all decisions and receives all profits and is responsible for all debts and obligations. Meanwhile, a non-individual company is a form of business managed by two or more people with different roles in running their business. Non-individual business actors consist of:

  1. Limited company;
  2. Public Company and Regional Public Company;
  3. Business Entity established by the Foundation;
  4. Cooperative;
  5. CV;
  6. Firm;
  7. Civil Guild
  8. Broadcasting Institution
  9. Public service agency; and
  10. Other legal entities are owned by the State.

Therefore, the travel agency business actor can be in the form of individuals or non-individuals. However, both of them are required to register through the Online Single Submission (OSS) system first to get a Business Identification Number (NIB) as the identity of the Business Actor.

Tourism Business License

Based on the Standard Indonesian Business Field Classifications (KBLI) as regulated in the Regulation of the Minister of Tourism and Creative Economy of the Republic of Indonesia Number 4 of 2021 concerning Standards for Business Activities in the Implementation of Risk-Based Business Licensing in the Tourism Sector, the Travel Bureau’s business has a KBLI Code of 79121. Doing business for this business actor consists of a Business License and a Commercial or Operational Permit.

Commercial or Operational License

As for Commercial or Operational Permits, you are required to have a Travel Bureau Business Certificate which is written evidence, given by the OSS Institution to entrepreneurs of low-medium-risk travel agencies who have made a self-declaration to implement/implement standards in organizing travel agency business at the time of registering the NIB through the OSS system.

This Business Certificate is valid for 3 years after issuance and can be renewed when its validity period has expired (Permenparekraf No. 10/2018). The Tourism Business Certificate is obtained after obtaining NIB.
